Terms of Service

Welcome to SnowLinks. These Terms of Service ("Terms") govern your use of the SnowLinks website and platform (the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use SnowLinks.

1. About SnowLinks

SnowLinks is a community platform operated from Australia. We help skiers and snowboarders connect with each other to share car rides and accommodation for trips to Australian ski resorts.

Important — what SnowLinks is and is not:

  • SnowLinks is an introduction service. We help members find each other.
  • SnowLinks does not provide transport, accommodation, travel, tour, or any other services to members.
  • SnowLinks is not a party to any arrangement made between members.
  • SnowLinks does not employ, contract, vet, or supervise drivers, hosts, or any other members.
  • Any ride, accommodation, or other arrangement is between the members involved. SnowLinks is not responsible for those arrangements.

2. Eligibility

To use SnowLinks you must:

  • Be at least 18 years old;
  • Have legal capacity to enter into a binding agreement under Australian law;
  • Provide accurate, current information about yourself;
  • Not have been previously suspended or removed from SnowLinks.

By creating an account you confirm you meet these requirements.

3. Your Account

You are responsible for:

  • The accuracy of your profile and trip information;
  • Keeping your sign-in credentials secure;
  • All activity that occurs under your account;
  • Using your real name and a genuine, recognisable photo of yourself.

You must not create more than one account, impersonate another person, or use the account of another person.

4. Community Standards

You agree that you will not:

  • Be dishonest about who you are, your trip plans, or what you are offering;
  • Harass, threaten, intimidate, stalk, defame, or discriminate against any other member;
  • Use the Platform for any commercial, promotional, or business purpose, including operating a commercial transport or accommodation service;
  • Charge more than a genuine cost contribution for rides or accommodation (see clauses 5 and 6);
  • Solicit other members for goods, services, donations, employment, or relationships outside the purpose of the Platform;
  • Share contact details of other members without their consent;
  • Post content that is unlawful, offensive, sexually explicit, hateful, or infringes anyone's rights;
  • Attempt to gain unauthorised access to the Platform, other members' accounts, or our systems;
  • Use bots, scrapers, or automated tools to access the Platform;
  • Use the Platform if you are subject to an apprehended violence order, intervention order, or similar protection order in relation to another member.

We may remove content, suspend, or permanently terminate your account at any time, without notice, if we believe you have breached these Terms or pose a risk to the community.

5. Carpool arrangements (drivers)

If you offer a ride through SnowLinks, you represent and warrant that:

  • You hold a current, valid Australian driver's licence appropriate to the vehicle;
  • The vehicle you will use is registered and roadworthy;
  • The vehicle is covered by a current comprehensive or third-party property insurance policy that permits the carriage of passengers in the manner you propose;
  • You will only seek a genuine contribution from passengers toward the actual cost of fuel and tolls — not a profit, fare, or commercial payment;
  • You will not drive while under the influence of alcohol, drugs, or any substance that impairs driving;
  • You will comply with all road rules, including those relating to snow chains and alpine driving conditions;
  • You are not currently disqualified from driving or subject to any driving-related court order.

You acknowledge that:

  • Personal motor vehicle insurance policies in Australia may not cover commercial passenger transport. Carrying passengers for profit may void your insurance, expose you to personal liability, and require commercial accreditation (such as point-to-point transport registration);
  • It is your responsibility to confirm your insurance covers carpool arrangements and that your contribution amounts are within cost-sharing limits;
  • SnowLinks does not verify any of the above and makes no representations about any driver.

6. Accommodation arrangements (hosts)

If you offer accommodation through SnowLinks, you represent and warrant that:

  • You have the legal right to share the accommodation (you own it, hold the lease, or have the owner's permission);
  • Sharing the accommodation complies with all applicable laws, by-laws, and regulations, including short-term rental registration requirements, strata by-laws, planning rules, council restrictions, and any conditions of your lease, mortgage, or insurance;
  • Your description, photos, location, and pricing are accurate and not misleading;
  • The accommodation is safe, clean, and fit for the purpose described;
  • You will only seek a genuine contribution from co-occupants toward the actual cost of the accommodation — not a profit, commercial rate, or fare;
  • You hold appropriate insurance, or accept the risk of not doing so.

You acknowledge that:

  • Many states, councils, and strata schemes regulate short-stay accommodation, including registration requirements (for example, the NSW Short-Term Rental Accommodation Register), night caps, and zoning restrictions. It is your responsibility to comply;
  • Home and contents insurance policies often exclude or restrict cover when paying guests are present. It is your responsibility to confirm your cover;
  • Income from sharing accommodation may have tax consequences. It is your responsibility to comply with your tax obligations;
  • SnowLinks does not verify any of the above and makes no representations about any host or property.

7. Members seeking rides or accommodation

If you use the Platform to find a ride or accommodation, you acknowledge:

  • SnowLinks does not verify drivers, hosts, vehicles, properties, or any information provided by other members;
  • You are responsible for your own decisions about whom to travel or stay with;
  • You should chat with the other member through the Platform before committing, ask questions, verify what matters to you, and meet in a public place if helpful;
  • You should not pay any money before meeting the other member and confirming the arrangement;
  • You are responsible for your own travel insurance, personal property, and personal safety.

8. Money between members

SnowLinks does not process or facilitate payments between members. Any contribution toward fuel, tolls, or accommodation costs is arranged and paid directly between the members involved.

You agree that any contributions will be genuine cost-sharing, not commercial payments. SnowLinks may suspend or terminate accounts that appear to be operating commercially.

9. No verification — your own judgement

SnowLinks does not perform background checks, identity verification, criminal record checks, driving record checks, vehicle inspections, accommodation inspections, or any other verification of members or what they offer. Profile photos, names, descriptions, and trip details are provided by members and have not been independently confirmed.

You use SnowLinks at your own risk, and you must use your own judgement when deciding whether to connect, travel, or stay with another member.

10. Release between members

You release SnowLinks from any claim, loss, damage, injury, or liability arising out of or connected with:

  • The conduct or omissions of any other member;
  • Any ride, accommodation, meeting, or other arrangement made between members, whether facilitated through the Platform or otherwise;
  • Any vehicle accident, property damage, theft, personal injury, illness, harassment, dispute, or other incident involving another member;
  • The accuracy, completeness, legality, or safety of anything offered, described, or said by another member.

This release applies to the maximum extent permitted by law.

11. Your indemnity to SnowLinks

To the maximum extent permitted by law, you agree to indemnify SnowLinks, its operators, contractors, and volunteers against any claim, loss, damage, cost (including legal costs on a full indemnity basis), or liability arising out of or connected with:

  • Your use of the Platform;
  • Your breach of these Terms;
  • Your conduct toward another member;
  • Any ride, accommodation, or other arrangement you enter into with another member;
  • Any content you post or information you provide on the Platform;
  • Any breach by you of any law, regulation, by-law, or third-party right.

12. Limitation of liability

Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Subject to that:

  • The Platform is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, secure, or that matches will be made or will be suitable.
  • To the maximum extent permitted by law, SnowLinks excludes all warranties, representations, and conditions not expressly stated in these Terms.
  • To the maximum extent permitted by law, SnowLinks is not liable for any indirect, consequential, special, or punitive loss, loss of profits, loss of opportunity, loss of data, or loss of enjoyment.
  • Where our liability cannot be excluded under the Australian Consumer Law for a service, our liability is limited (where the law permits) to re-supplying the service or paying the cost of re-supplying it.
  • Our total aggregate liability to you under or in connection with these Terms is, to the maximum extent permitted by law, limited to AUD $100.

13. Intellectual property

SnowLinks, the SnowLinks name and logo, the website design, and all content we create remain our property. You may not copy, reproduce, modify, or use any of it without our written permission, except for your normal personal use of the Platform.

Content you post (your profile, photos, bio, trip information) remains yours. By posting it, you grant SnowLinks a non-exclusive, worldwide, royalty-free licence to host, display, and use it to operate and promote the Platform.

14. Privacy

Our handling of your personal information is described in our Privacy Policy. By using SnowLinks you acknowledge that policy.

15. Suspension and termination

We may suspend, restrict, or terminate your account at any time, with or without notice, including if:

  • You breach these Terms or our Community Standards;
  • Another member reports a safety, conduct, or trust concern;
  • We believe your account is being used commercially or fraudulently;
  • We are required to do so by law;
  • We discontinue the Platform.

You may close your account at any time via your account settings or by contacting us at admin@snowlinks.com.au.

16. Reporting concerns

If you have a safety, conduct, or trust concern about another member or an arrangement made through SnowLinks, please contact us at admin@snowlinks.com.au.

If you are in immediate danger, contact emergency services on 000.

17. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify registered users by email or via the Platform. Your continued use of SnowLinks after the change is posted constitutes acceptance of the updated Terms.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and SnowLinks submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.

19. General

  • If any part of these Terms is found to be invalid or unenforceable, the rest continues to apply.
  • These Terms are the entire agreement between you and SnowLinks regarding the Platform.
  • Our failure to enforce a right is not a waiver of that right.
  • You cannot transfer your account or rights under these Terms without our consent.
